SOCIAL SECURITY FEE PETITIONS
When filing Equal Access to Justice Act fee petitions in Social Security cases, a copy of the Social Security Administration's award letter must accompany the petition. Counsel also is required to provide a sworn, itemized statement of all time expended representing the client before the court.
If these items are not filed, an order will be entered requiring counsel to do so within ten (10) days. If these items are not filed in a timely manner, the petition will be denied.
The fee petition should state whether the Commissioner objects to the amount of the fee. If the fee petition does not reflect agreement of the parties regarding the amount of the fee, the Commissioner will be ordered to file any opposition within 30 days.
