Status Report: Smarter Sentencing Act

Tuesday, September 02, 2014

The court has received numerous inquiries concerning the bipartisan Senate bill called the Smarter Sentencing Act (S. 1410).  This bill passed the Senate Judiciary Committee on January 30, 2014, and has a House companion bill (H.R. 3382) that is pending in the House Judiciary Committee.  If the bill is eventually passed by Congress in its current form and signed into law by the President, it will, for most federal drug offenses, reduce mandatory minimum sentences and expand the application of both the Fair Sentencing Act of 2010 and the existing “safety valve” under 18 U.S.C. § 3553(f).  Further updates will be posted when available.
