As outlined in the Administrative Procedures for Filing, Signing, and Verifying Pleadings and Papers by Electronic Means in the United States District Court for the Western District of Virginia, proposed orders are to be submitted with motions for which a supporting brief is not required. Proposed orders submitted for entry must be sent to chambers by email as a Word formatted attachment to Memmer.ECF@vawd.uscourts.gov and copying all counsel or unrepresented parties on the email.

Discovery Disputes

In accordance with Federal Rule of Civil Procedure 37(a)(1), when a discovery dispute arises, counsel and any unrepresented parties are required to participate in good faith in a meaningful meet and confer process before seeking court intervention. The meet and confer is expected to be by telephone, video, or in person. If the parties are unable to resolve the discovery dispute during the meet and confer, counsel and any unrepresented parties are directed to schedule a discovery status conference with Judge Memmer prior to filing a discovery motion.
